ORDINANCE NO.: 2025-002
AN ORDINANCE OF GENERAL AND PERMANENT NATURE ESTABLISHING THE USE OF ELECTRONIC VOTE COUNTING DEVICES

WHEREAS, Chapter 24 of Title 17 of the Alabama Code of 1975, and the regulations adopted pursuant thereto by the Alabama Electronic Voting Committee, provide for the use of Electronic Vote Counting Systems; and

WHEREAS, Section 17-7-21 of the Code of Alabama 1975 provides that a municipality may, in its discretion, by adoption of an appropriate resolution, authorize, adopt, and direct the use of electronic vote counting systems for use in all elections held in such municipality;

NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Berlin, Alabama, while in a Regular Council Meeting, as follows:

Section 1.  Electronic vote counting system.

  • That for all elections held subsequent to the passage of this ordinance, that Cullman County supplies the Town of Berlin with voting devices and that the Town of Berlin adopts the DS200 Electronic Vote Counting System that the County will use or any subsequent model device, which complies with Section 17-7-21 of the Code of Alabama and also adopts the ExpressVote System or any subsequent model device that the County will use, which complies with Section 17-2-4 of the Code of Alabama; and any regulations adopted pursuant thereto, is hereby authorized for the reporting, counting, and tabulating of any and all election results
  • The Town of Berlin shall hand count their absentee ballots.

Section 2.  That a copy of this Ordinance will be filed with the Alabama Secretary of State as provided in Section 17-7-21 of the Code of Alabama 1975.

Section 3.  That this Ordinance shall become effective upon its adoption and publication as required by law.
