LEGAL NOTICE OF ACTION PROPOSED TO BE TAKEN BY THE TOWN OF BERLIN
Pursuant to the Amendment No. 772 to the Constitution of Alabama (1903) (Section 94.01 (c) (2) of the Recompiled Constitution of Alabama and hereinafter referred to as “Amendment No 772”, the Town of Berlin, Alabama (the “Town”) hereby gives notice that the Town Council will consider, at a regular meeting to be held on Monday, May 16, 2022 at 7PM located at the Berlin Community Center, the approval of a resolution that authorizes execution and delivery of an Economic Development Agreement by and between the Town of Berlin and Berlin Hardware and Farm Supply, LLC and
WHEREAS, Amendment No. 772 to the Constitution of Alabama (1901) (Section 94.01 (c) (2) of the Recompiled Constitution of Alabama authorizes the Town of Berlin, as a municipal government in the State of Alabama, to lend its credit to or grant public funds and the things of value to aid any corporation, or other business entity for the purpose of promoting the economic development within its jurisdiction; and
WHEREAS, Berlin Hardware and Farm Supply, LLC is operating a hardware and farms supply store in the town limits of the Town of Berlin, Alabama; and
WHEREAS, Berlin Hardware and Farm Supply, LLC has requested economic development assistance and incentives totaling $17,000 toward resolving issues with drainage running under US Highway 278; and
WHEREAS, an Economic Development Agreement has been prepared for council approval and public notice has been given of the impending action as set forth in Amendment No. 772; and
WHEREAS, the incentive shall be up to Seventeen Thousand and 00/100 Dollars ($17,000) from Economic Development grants received by the Town for this project.
WHEREAS, the Town shall determine in said public meeting that the public benefits sought to be achieved by the approval of the Economic Development Agreement include promotion of the local economic and commercial development, stimulation of the local economy, increase employment opportunities, expansion of the Town’s tax base resulting in additional tax revenues and enhancement of the overall quality of life for the citizens of Berlin and Cullman County, Alabama.
CONCLUSION
A draft of the resolution shall be inspected in the office of the Town Clerk. All members of the public are invited to attend the meeting described above or to submit written opinions or comments regarding the proposed action to the Town Clerk by noon Friday, May 13, 2022, prior to the meeting. In compliance with ADA, responsible accommodations will be provided to individuals needing assistance upon their request. Such requests must be made to the office of the Town Clerk ( 256) 736-3138 no later than Friday noon prior to the Council Meeting.
