BERLIN FARMERS MARKET EVENT SITE RESERVATION AGREEMENT
The Berlin Farmers Market and Event Site is governed by the Town of Berlin and their designated agents. All individuals, organizations, and groups utilizing Town property are subject to the provisions of Ordinance No. 2026-001, An Ordinance Establishing Rules and Regulations for the Berlin Community Park and Farmers Market Site, as well as the terms, conditions, and rules set forth in this Reservation Agreement.
By submitting a reservation request, the reserving individual, organization, or group acknowledges and agrees to comply with all applicable federal, state, and local laws, the provisions of Ordinance No. 2026-001, and any policies, procedures, or operational requirements established by the Town of Berlin.
The Town of Berlin and their designated agents reserve the right to establish, modify, interpret, and enforce additional rules, restrictions, and operational requirements as deemed necessary to protect Town property, ensure public safety, preserve the orderly operation of the facility, and promote the best interests of the Town. Such additional rules shall have the same force and effect as the conditions contained in this Reservation Agreement and shall be binding upon all users of the facility. Failure to comply with these requirements may result in the immediate termination of the reservation and/or the denial of future reservation privileges.
RESERVATION ELIGIBILITY
Pavilion reservations are limited to community-oriented events that are open to the general public. Reservations may be requested by individuals, organizations, businesses, community groups, civic groups, nonprofit organizations, or other entities whose proposed event provides a public benefit and aligns with the intended use of the facility.
Private gatherings or personal celebrations, including but not limited to birthday parties, family reunions, graduation parties, weddings, baby showers, bridal showers, anniversaries, or similar private events, are not permitted for reservations.
The Town of Berlin and designated agent(s), reserves the right to review, approve, deny, or restrict any reservation request to ensure that proposed events are community-focused, appropriate for the facility, and consistent with the purpose of the Berlin Farmers Market and Event Site.
RESERVATION AVAILABILITY AND FARMERS MARKET PRIORITY
Approval of a reservation does NOT grant exclusive use of the Berlin Farmers Market and Event Site and facilities. The property shall remain open to the general public, and all public amenities, including restrooms, parking areas, walkways, and other common areas, shall remain accessible throughout the duration of the reserved event.
Reservation of the pavilion or designated event space does NOT restrict or deny public access to any portion of the Berlin Farmers Market and Event Site property. The Town of Berlin reserves the right to conduct Town business, operate the Berlin Farmers Market, and permit public use of the property at all times.
The reserving individual, organization, or group shall not prevent, obstruct, restrict, or discourage members of the general public from accessing or utilizing any public facilities, amenities, or areas of the Berlin Farmers Market and Event Site during the reserved event.
The Berlin Farmers Market, including its approved growers and vendors, shall have first priority for the use of the pavilion, market space, and surrounding designated areas at all times, including during previously approved reservation periods. Any reservation of the facility shall remain subordinate to the operational needs of the Berlin Farmers Market. The Town of Berlin reserves the right to modify, relocate, suspend, or cancel any reservation if necessary to accommodate Farmers Market operations, approved growers, vendors, or other Town-sponsored activities.
RESERVATION RULES & REGULATIONS
HOURS OF OPERATION: The Berlin Community Park and Farmers Market Site is open to the public daily from dawn to dusk. No person shall remain on the property outside of operating hours except authorized Town personnel, law enforcement, or individuals with written permission from the Town of Berlin.
- Littering Prohibited: No person shall litter. All trash must be disposed of in designated receptacles.
- Pets/ Animals: Animals are permitted within the park and farmers market property provided they are kept on a leash at all times, and owners are responsible for cleaning up after them.
- Alcohol and Drugs: The possession or use of alcohol or illegal drugs is strictly prohibited.
- Smoking and Vaping: Smoking, vaping, and the use of tobacco or nicotine products, including smokeless tobacco, are prohibited within twenty-five (25) feet of any playground area or farmers market facility.
- Motorized Vehicles and Bicycles: Motorized vehicles and bicycles are prohibited within the park except in designated areas or as authorized by the Town.
- Wildlife and Vegetation: No person shall harm, disturb, or remove any wildlife, plants, trees, or natural features.
- Noise Restrictions: No person shall create excessive noise or use amplified sound without express written permission from the Town of Berlin or its authorized agents.
- All trash, boxes, and materials must be removed before leaving.
- No illegal, counterfeit, or prohibited items may be sold.
- Persons shall conduct themselves in a courteous and professional manner.
- No glass bottles.
- Playground equipment is reserved for use by children only.
- No inflatables
- The reserving individual, organization, or group shall be responsible for the security of their own merchandise, equipment, cash, and personal belongings.
- Reservation space shall not be used for the sale of goods, products, or services for personal or individual financial gain.
ENFORCEMENT OF RULES & REGULATIONS
The Town of Berlin, through its designated agent(s), shall take such actions as are necessary to enforce these rules and regulations. Law enforcement officers may issue citations or appearance tickets as authorized.
The Town of Berlin, through its designated agent(s), shall have the authority to seize and confiscate any property, item, or device used in violation of Ordinance No. 2026-001, in accordance with applicable laws.
Failure to comply with any of the above rules and regulations may result in the immediate loss of reservation privileges. The Town of Berlin reserves the right to refuse future reservations or use of the facility to any individual, organization, or group that violates these rules, causes damage to Town property, or otherwise fails to use the facility in a safe, lawful, and respectful manner.
HOLD HARMLESS, LIABILITY, AND WAIVER
Individuals, organizations, or groups assume all risks associated with reservations. The Town of Berlin, its elected officials, employees, volunteers, sponsors, and agents shall not be responsible for lost, stolen, or damaged property, personal injury, illness, death, accidents, vehicle damage, weather-related losses, equipment damage, product damage, or loss of income. Individuals, organizations, or groups agree to indemnify and hold harmless the Town of Berlin from any claims arising out of participation. Individuals, organizations, or groups are responsible for maintaining any insurance required by law.
