RESOLUTION NO. 2025-005
A RESOLUTION APPROVING AND ASSENTING TO A VACATION OF AN UNNAMED COUNTY ROAD SOUTH OF COUNTY ROAD 1611

BE IT RESOLVED, by the Town of Berlin, Alabama as follows:

WHEREAS, pursuant to Ala. Code § 23-4-20 (1975), The Town of Berlin is required to hold a public hearing, notice of which is required by statute, to determine the assent to the vacation.

WHEREAS, That an unnamed County Road south of County Road 1611 to be vacated has abutting lots or parcels of land owned by Josefina Valencia Hernandez, Eulalio Rodriguez Aburto, Bobby Ray Hill, Sherrie Giles Hill, Minyard H. Blair, Jr, Joyce I. Blair, and Ashley Graves Bates;

WHEREAS, The Town of Berlin is duly satisfied that vacating an unnamed County Road
South of County Road 1611, in its entirety, is in the interest of the public;

WHEREAS, The Town of Berlin is satisfied that vacation of said road will not deprive other property owners of any right they may have to convenient and reasonable means of ingress and egress to and from their property;

NOW THEREFORE, BE IT RESOLVED, pursuant to Title 23-4-2, et. seq. Code of Alabama, 1975 that an unnamed County Road South of County Road 1611, is hereby vacated as
described:

The existing unnamed County Road South of County Road 1611 in its entirety, more
specifically shown in Exhibit “A” attached hereto;

IT IS FURTHER RESOLVED, that this resolution shall be made a part of the Minutes of
Meeting of the Town of Berlin at which this action has been taken. The Clerk is hereby authorized and directed to effectuate such ministerial tasks. Additionally, this resolution shall be filed in the Probate Court of Cullman County by the Clerk of the Town of Berlin.

IT IS FURTHER RESOLVED, that the filing of this resolution shall operate as a declaration of the Town of Berlin’s vacation and shall divest all public rights and liabilities, including any rights which may have been acquired by prescription, in that part described above.

IT IS FURTHER RESOLVED, that any entity with utility lines, equipment, or facilities in place at the time of vacation, shall have the right to continue to maintain, extend, and enlarge their lines, equipment, and facilities to the same extent as if the vacation had not occurred.

IT IS FURTHER RESOLVED, that the Clerk of the Town of Berlin is further instructed
to publish once a week in a newspaper in Cullman County no later than Fourteen (14) days after
adoption of said resolution.
